Terms and Conditions of the Homiens Art Prize
- By entering the Homiens Art Prize, you agree to the following Terms and Conditions.
- Entrants give consent to receive email communications from Homiens.
- Ownership of all artworks entered remains with the artist: Entrants are free to exhibit elsewhere and display their artworks elsewhere. Homiens asks for the perpetual non-exclusive right to display images that have been submitted of winning and finalist artworks (further details below). The Homiens Art Prize is a non-acquisitive prize.
- We do not accept entries by regular mail. We advise that we are unable to return or provide a refund on any artwork(s) sent to us by post. Entrants are at no stage required to send physical artworks to Homiens, and do not need to travel at any stage. The Homiens Art Prize has no physical, in-person, or attendance-based component. At least one of the image(s) or file(s) of each artwork submitted must represent the work in its entirety. Please do not submit segments or details of a work without also submitting an image or file of the entire work.
- An authorized representative may submit an entry on an artist’s behalf, provided they have the artist’s full consent and the artist agrees to these T&C as the official Entrant. The artist will be required to confirm that they agree to these T&C if selected as a winner or finalist. Homiens is not responsible for any disputes between an artist and their representative.
- Alterations after submission, and refunds (except where noted), will not be possible.
- All references in this T&C to Homiens are inclusive of any employees, and owners of Homiens. At the time of submission, copyright in all elements of the Entry must reside solely with the Entrant(s). All works must be original. Works which reference other works must acknowledge the referenced work on the entry form. All artists who have contributed to the Entry must be identified by name and email address on the entry form. All collaborating artists must be aware of, and agree to Entry, and must also agree to these T&C. Entrant(s) warrants that exhibition by Homiens will not be unlawful, or infringe upon any rights, or give rise to any claim by any third party including without limitation claims in defamation, privacy, copyright, or trademark. The Entrant(s) agrees to indemnify and hold harmless Homiens for any rights violations, or damage, including copyright, resulting from submission, or exhibition. No unprofessional behavior. Communications between the Entrant(s) and Homiens are private, confidential, and intended for the recipient only. Entrant(s) grant Homiens the perpetual non-exclusive right to display winning, and finalist entries, along with these Entrants’ names, biographies, and images in all of our media, including but not limited to exhibition catalogs, social media, subsequent publications, merchandise, and online for purposes including but not limited to marketing, promotion, and education in direct connection with Homiens and the Homiens Art Prize. Entrant(s) grant Homiens the perpetual exclusive right to publish and reproduce interviews and comments submitted along with the Entrant’s name and biography in all of our media. Homiens may licence these specific, limited rights to others only for the same purposes in direct connection with Homiens and the Homiens Art Prize. The Entrant(s) grants Homiens the perpetual right to display the name of all highly commended artists. Award money is inclusive of all fees related to our ongoing rights. Homiens reserves the right to disqualify and revoke the titles and prizes of any Entrant that breaches the T&C. Homiens reserves the right to not exhibit or publish, or to cease exhibition and publication, of any artist or artwork. Homiens reserves the right to remove references to any Entrant(s) from our media. Homiens is not resourced to issue personalized invoices for entry fees. If selected as a winner, finalist, or to be featured as a Promoted Artist or in Meet the Artists, Entrant(s) grant Homiens the right to exhibit and publish the entry as submitted. Before exhibition or publication, Homiens reserves the right, without altering substantive content, to make minor edits to the spelling, tense, grammar, and syntax of the entries of a winner, finalist, or Entrant(s) to be featured as a Promoted Artist or in Meet the Artists, as required. Homiens reserves the right to extend the deadline of a submission opportunity. Homiens reserves the right to refuse service. To assist with timely administration of the Prize, we require that all Entrants respond to the queries contained in our emails within 72 hours.
- In the unlikely event that an element of the Homiens Art Prize is canceled, postponed, or not available, that element of the Prize is forfeit (this has never happened). The winners of the Homiens Art Prize must invoice Homiens, and collect payment, within three months of request of invoice, or the Prize money is forfeit. We require that Entrants maintain confidentiality regarding their selection as a winner, finalist or highly commended artist until the results are announced publicly, or unless informed otherwise. These T&Cs of the Homiens Art Prize supersede all other agreements, written or verbal. Homiens will always seek Entrants’ permission before submitting an Entry for consideration to further award bodies and opportunities.
